Terms of Service

These Terms of Service ("Terms") govern your use of Le Moulin (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Le Moulin generates Instagram-format carousels using AI (text content via OpenAI's language models, images via OpenAI's image generation model). You provide a topic; the Service produces editable slide content + visuals; you edit them and either download or publish the result.

2. Account

• You must be at least 13 years old to use the Service (16 in EU jurisdictions).
• You're responsible for activity under your account. Don't share credentials.
• Notify us immediately if you suspect unauthorized access.

3. Subscriptions, credits, and refunds

• The Service is offered on monthly subscription plans (Pro, Max) plus optional one-time top-up credit packs.
• Subscription credits expire at the end of each billing month. Unused credits don't roll over. Each new cycle starts fresh.
• Top-up pack credits expire 90 days after purchase.
• Failed generations are automatically refunded to the same credit grant they were spent from.
• Subscriptions can be cancelled at any time and stay active until the end of the current billing period. We do not offer pro-rata refunds for partial-month cancellations.
• Payments are processed by Stripe. Any chargeback must be initiated through your card issuer.

4. Acceptable use

You agree NOT to use the Service to:

• Generate sexual or sexually-suggestive content involving real people or minors.
• Generate content that depicts real, identifiable individuals in a misleading or defamatory way.
• Generate content that infringes copyrights, trademarks, or other intellectual property.
• Generate hate speech, harassment, or content inciting violence.
• Spam Instagram or any other platform with automated content at a frequency that violates that platform's rules.
• Reverse-engineer, scrape, or automate the Service in ways not provided by official APIs.
• Resell or sublicense the Service without our written agreement.

OpenAI's content policy applies on top of these rules. Repeated content-policy violations will result in suspension or permanent ban without refund.

5. Your content + IP

• You own the carousels you generate. We grant you full commercial-use rights to all generated images and text via OpenAI's API terms.
• You retain ownership of any text prompts, reference images, and edits you contribute.
• You grant us a limited license to store + process your content for the purpose of providing the Service.
• We do not use your content to train models. OpenAI's API does not train on inputs by default and we do not opt in.

6. Instagram publishing

When you connect Instagram and use the "Publish to Instagram" feature, the Service uploads your generated content to Instagram via the Meta Graph API on your behalf. You're responsible for ensuring your content complies with Instagram's Community Guidelines and Terms. We're not liable for any post being removed, demoted, or flagged by Instagram.

7. Service availability

We aim for high uptime but make no SLA guarantees on the current plans. Maintenance windows or third-party outages (OpenAI, Supabase, Inngest, Stripe, Meta) may temporarily interrupt the Service. We'll do our best to notify you in advance for planned downtime.

8. Termination

You can delete your account at any time via the account page. We may suspend or terminate your account for violations of these Terms or for prolonged inactivity (12+ months). Upon termination, your data is deleted within 30 days except where legal retention requirements apply.

9. Disclaimer + limitation of liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Changes

We may update these Terms occasionally. Material changes will be communicated by email at least 14 days in advance. Continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the jurisdiction where Le Moulin is registered. Any disputes will be resolved in the courts of that jurisdiction.
